These Terms of Service (“Terms”) govern your access to and use of lonivas.com, including all related content, features, products, tools, and services offered through the website (collectively, the “Services”).

The Services are operated by Lonivas and powered by Shopify.

By visiting the Site, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, Return Policy, Shipping Policy, and any other policies referenced on the Site.

If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility

By using the Services, you represent that you are at least the age of majority in your state or place of residence.

If you are under the age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian.

You may not use the Services for any illegal, fraudulent, abusive, or unauthorized purpose.

5. Product Availability

If an ordered product becomes unavailable after your order is placed, we will notify you and refund the amount paid for the unavailable product.

We do not guarantee that every payment method will remain available at all times.

10. Shipping and Delivery

Available shipping methods, estimated delivery periods, and applicable charges are displayed on the Site or during checkout.

Unless clearly stated otherwise, delivery dates are estimates rather than guaranteed arrival dates.

We will make reasonable efforts to ship orders within the timeframe stated at the time of purchase. If we cannot ship within the stated timeframe, we will provide notice and available options as required by applicable law, which may include consenting to the delay or canceling the affected order for a refund.

Delays may occur because of:

Carrier disruptions
Severe weather
Customs processing
Incorrect or incomplete addresses
Security or payment verification
Events outside our reasonable control

Customers are responsible for providing a complete and accurate delivery address. Please contact us immediately if an address needs to be corrected. We cannot guarantee that an address can be changed after fulfillment begins.

Unless otherwise required by applicable law, title and risk of loss pass to you when the order is delivered to the shipping address provided at checkout.

11. Lost, Damaged, or Incorrect Orders

Please inspect your order promptly after delivery.

If an item arrives damaged, defective, incomplete, or different from what you ordered, contact us through our Contact Page and provide:

A description of the issue
Clear photographs of the item and packaging

We will review the claim and, when appropriate, provide a replacement, refund, or another legally available remedy.

Nothing in these Terms limits rights you may have under applicable consumer-protection laws.

12. Returns and Refunds

Returns and refunds are governed by our Return Policy, which is incorporated into these Terms by reference.

Eligible return requests must be submitted within 30 days of delivery and must satisfy the conditions stated in the Return Policy.

Products marked Final Sale before purchase may not be returnable, except where return or refund rights are required by law.

If these Terms conflict with the Return Policy regarding a return, the Return Policy will control.

13. Promotions and Discount Codes

Promotional offers and discount codes may be subject to separate terms, including:

Discount codes have no cash value and may not be sold, transferred, reproduced, or exchanged for cash unless expressly stated.

Jewelry may naturally change in appearance over time depending on its materials, frequency of wear, storage, and exposure to water, chemicals, perfume, lotions, sweat, or environmental conditions.

Normal wear, accidental damage, improper care, and unauthorized alterations may not qualify as manufacturing defects.

We will not describe a product as waterproof, hypoallergenic, tarnish-resistant, or covered by a warranty unless that representation is supported by the applicable product specifications.

You may be permitted to submit reviews, comments, photographs, feedback, ideas, or other content (“User Content”).

You retain ownership of your User Content.

By submitting User Content to us, you grant Lonivas a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, translate, display, distribute, and promote that content in connection with our business and Services.

This license continues unless and until you request removal where applicable, although previously distributed marketing materials may not be immediately retractable.

You represent that:

You own or have permission to submit the User Content
The content is truthful and based on your genuine experience
The content does not violate another person’s rights
The content is not defamatory, unlawful, deceptive, or malicious
The content does not contain malware or harmful code

We may moderate or remove User Content that violates these Terms, but we are not required to monitor every submission.

We will not knowingly present fabricated reviews as genuine customer feedback.

16. Intellectual Property

The Site and its content—including trademarks, logos, product names, photographs, graphics, videos, designs, text, layout, software, and other materials—are owned by or licensed to Lonivas and are protected by applicable intellectual-property laws.

To the fullest extent permitted by law, our aggregate liability relating to a particular purchase will not exceed the amount you paid for the product giving rise to the claim.

Gross negligence where legally applicable

Non-waivable consumer-protection rights

This section does not require you to indemnify Lonivas for claims caused by Lonivas’s own unlawful conduct, negligence, or breach of these Terms.

Used the Services fraudulently or unlawfully

The remaining provisions will remain in effect.

Any ambiguity will not automatically be interpreted against the party that drafted the Terms.
